A 1986 graduate of the University of California, Hastings College of the Law, Garth A. Gersten's practice is concentrated on insurance coverage, representing and advising policyholders and insurers. Garth has been selected for The Best Lawyers in America© for his work in insurance law.

Garth is focused on having policyholder clients be proactive with their insurance program. To that end, he reviews existing insurance programs for policyholders and advises on gaps and overlaps. He also reviews and revises contractual insurance and indemnity provisions to make sure his clients' interests are protected.


Garth initially practiced in California representing major insurers, providing advice, and handling bad faith and declaratory judgment litigation, including several large pollution and construction defect cases. He moved to North Carolina, where he represented insurers and policyholders and was a frequent presenter at insurance coverage seminars.  Garth was Chair of the Government Affairs Committee for the North Carolina Captive Insurance Association.  Now residing in Illinois, Garth continues to focus on insurance issues - large and small. 


A trained mediator, Garth can help with resolving your disputes.

Garth has been active in Pro Bono matters, receiving a Defender of Justice Award in 2003 from the North Carolina Justice and Community Development Center for his work in litigation with the State of North Carolina over dental access issues for children under Medicaid.


Garth is a member of the North Carolina State Bar, Illinois State Bar, an inactive member of the State Bar of California, and admitted to practice in North Carolina, Illinois, California, the United States Court of Appeals for the Fourth and Ninth Circuits and the United States District Courts in California, Illinois and North Carolina. Garth is a member of DRI, ABA, ISBA and NCBA.  Garth also has taught Appellate Advocacy at Golden Gate University School of Law in San Francisco.

Garth's wife, Janet, is a tenured professor in Business Administration at the University of Illinois.  His oldest daughter attends the University of Michigan.  His youngest daughter attends Centennial High School in Champaign, Illinois.
